These Terms and Conditions ("Terms") govern your access to and use of the Site, its content, tools, calculators, APIs, and any related services (collectively, the "Services"). By accessing, browsing, or otherwise using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, you must immediately discontinue all use of the Services.
1. Nature of the Service — Information Only
The Services provide indicative, aggregated, and time-delayed information regarding gold, silver, foreign exchange and related market data, primarily in relation to the Egyptian market. All prices, rates, calculations, charts, and other content are provided strictly for general informational and educational purposes and do not constitute, and shall not be construed as, financial, investment, tax, legal, accounting, or other professional advice, a recommendation, an offer, a solicitation, or a quotation to buy, sell, hold, exchange or otherwise transact in any commodity, currency, security, or financial instrument.
You are solely and exclusively responsible for any decision you make on the basis of the Services and for verifying any price or data with a licensed dealer or qualified advisor before entering into any transaction. The Site is not a broker, dealer, exchange, market maker, custodian, payment processor, or financial institution.
2. No Warranty — "AS IS" and "AS AVAILABLE"
To the fullest extent permitted by applicable law, the Services are provided strictly on an "AS IS" and "AS AVAILABLE" basis, with all faults and without any warranty, representation, condition, or undertaking of any kind, whether express, implied, statutory or otherwise, including without limitation any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, currency, reliability, non-infringement, title, availability, security, or quiet enjoyment.
Without limiting the foregoing, we do not warrant that: (a) the Services will be uninterrupted, secure, timely, error-free, or free of viruses or other harmful components; (b) any data, price, rate, calculation or other content displayed will be accurate, complete, current, or reflective of any actual market price; (c) defects will be corrected; or (d) the Services will meet your requirements or expectations.
3. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall EgyptGoldPrices.com, its owners, operators, founders, directors, officers, employees, agents, contractors, partners, licensors, suppliers, or affiliates (collectively, the "Released Parties") be liable to you or to any third party for any direct, indirect, incidental, special, exemplary, punitive, consequential, reliance, or any other damages whatsoever, including without limitation loss of profits, loss of revenue, loss of business, loss of goodwill, loss of data, loss of opportunity, trading losses, market losses, or any other intangible losses, arising out of or in any way connected with: (a) your access to, use of, inability to access, or inability to use the Services; (b) any reliance placed by you on any content of the Services; (c) any conduct or content of any third party on or in connection with the Services; (d) any errors, omissions, inaccuracies, delays, interruptions, suspensions, or discontinuations of the Services; (e) any unauthorized access to or alteration of your transmissions or data; or (f) any other matter relating to the Services, whether based on warranty, contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not the Released Parties have been advised of the possibility of such damages.
Where liability cannot be excluded under applicable mandatory law, the aggregate liability of the Released Parties to you for all claims arising out of or in connection with the Services shall in no event exceed one hundred Egyptian pounds (EGP 100) or the equivalent in your local currency, which you acknowledge to be a fair and reasonable cap given that the Services are provided free of charge.
4. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of or reliance on the Services; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; or (d) any transaction or decision you take in reliance on any information made available through the Services.
5. No Financial, Investment or Professional Advice
Nothing on the Services constitutes a recommendation by us that any particular commodity, currency, security, transaction or strategy is suitable for any specific person. Investments and commodity trading involve risk, including risk of total loss. Past performance is not a reliable indicator of future results. Before acting on any information, you should consider its appropriateness having regard to your own objectives, financial situation, and needs, and obtain independent professional advice.
6. Third-Party Data and Links
The Services may incorporate or display data, content, links, or materials sourced from third parties. The competent courts of Cairo, Egypt shall have exclusive jurisdiction to settle any such dispute or claim, save that we retain the right to bring proceedings in any other jurisdiction where you reside or have assets.
12. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. No failure or delay by us in exercising any right shall constitute a waiver of that right.
